Tokyo District Court delays and ruling 2007–08 Berlitz Japan strike



union members , supporters hear details of tokyo district court ruling on february 27, 2012.


after months of court hearings, in december 2009 company , union, following recommendation of judge watanabe, lead judge in case, entered talks. once-a-month, 30-minute negotiating sessions held.


in 2010 negotiations dealing several issues, including amount of notice union members should give if intend strike. in october 2010 negotiations broke down , court case resumed in december 2010.


hearings continued , berlitz suit against union dismissed tokyo district court on 27 february 2012. 43-page ruling entirely in union s favor, of strikes conducted being recognized legal court. court s ruling said: there no reason deny legitimacy of strike in entirety , details of parts — objective, procedures, , form of strike. therefore there can no compensation claim against defendant, either union or individuals. , therefore judgement of court claims rejected.


according yumiko akutsu, 1 of lawyers union, win complete victory — on not 1 point did lose, not 1 single point. however, within week of ruling berlitz had decided appeal high court.
